Legal Notice for Individuals (and Sole Proprietorships)

Article 1 – Training

The training is designed as a linguistic introduction and general learning of French with a medical theme.

Article 2 – Early performance and waiver of the right of withdrawal

In accordance with Article L221-25 of the French Consumer Code, when a training contract is concluded remotely, performance may begin before the expiration of the legal fourteen (14) day withdrawal period only at the express request of the consumer.
By confirming the order and expressly agreeing to the immediate start of the training before the end of the withdrawal period, the Client acknowledges:
• Having been informed of their legal fourteen-day right of withdrawal;
• Expressly requesting the early performance of the training service;
• Waiving their right of withdrawal if the training is fully performed before the end of the withdrawal period, in accordance with Article L221-28, 1° of the French Consumer Code.
In the event of withdrawal after the training has started but before its completion, the Client remains liable for the portion of the training actually provided up to the date of withdrawal notice, calculated on a pro rata basis.
This provision applies only to consumer Clients as defined by the Consumer Code. Professionals are not entitled to a right of withdrawal.

Article 3 – Payment terms

The price of the training is indicated in euros, all taxes included (VAT not applicable, Article 293 B of the French General Tax Code).
Payment is due according to the following terms, unless otherwise agreed in writing between the parties:
• For individuals: full payment is due no later than the start date of the training, unless a payment schedule has been agreed upon by LEFORT Pascaline.
• For professionals: payment is due upon receipt of the invoice, within a maximum of 15 calendar days, unless more stringent terms apply.
No discount is granted for early payment.
In case of late payment, penalties are automatically due the day following the due date, without prior notice, at a rate equal to three times the legal interest rate in effect, plus a fixed compensation of 40 euros for recovery costs, in accordance with Articles L441-10 and D441-5 of the French Commercial Code.
In the event of full or partial non-payment, LEFORT Pascaline reserves the right to:
• Suspend access to the training until payment is regularized,
• And/or terminate the contract at the Client’s sole fault, without prejudice to amounts already due.
Accepted payment methods are specified at the time of registration (bank transfer, credit card, online payment, etc.).

Article 4 – Intellectual property

All content, regardless of its format (written or digital documents, PowerPoint presentations, videos, PDF files, exercises, technical sheets, diagrams, recordings, etc.), provided as part of the service, remains the exclusive property of LEFORT Pascaline or their respective authors, protected under the French Intellectual Property Code.
The Client agrees to respect the intellectual property rights attached to this content and to use it solely for their personal use, within and only for the needs of the training.
Any reproduction, representation, modification, publication, transmission, distribution, or generally any unauthorized use of all or part of the content, by any means and on any medium, is strictly prohibited without the prior written consent of LEFORT Pascaline.
Any breach of these terms may constitute an act of counterfeiting, incurring the civil and criminal liability of the perpetrator, pursuant to Articles L335-2 and following of the French Intellectual Property Code.
This clause applies for the entire duration of the training and continues after its completion, without time limitation.

Article 5 – Protection of personal data

Information collected during the service is processed by LEFORT Pascaline for administrative, educational, and financial management purposes. This processing is based on contractual execution, compliance with legal obligations, and, where applicable, your consent (Article 6, §1, a) for optional processes such as sharing testimonials or sending commercial communications.
Data is strictly necessary for these purposes and accessible only to authorized individuals. It is kept for the legal period required for its processing.

Article 6 – Financial conditions

Invoicing is issued upon acceptance of the quotation. The services provided do not constitute training actions as defined by Article L.6313-1 of the French Labor Code and therefore cannot be subject to payment delegation by an OPCO or public funding.
Any cancellation request, regardless of reason, must be confirmed in writing at least two business days before the service start date and will result in a cancellation fee equal to 40% of the service price. Late cancellations are billed as completed services.

Article 7 – Exclusion of public funding

The Client expressly acknowledges that the training covered by these terms is not eligible for any public or mutualized professional training funding mechanism, such as: the Compte Personnel de Formation (CPF), schemes managed by skills operators (OPCO), the Aide Individuelle à la Formation (AIF) from Pôle emploi, or any other public or semi-public funding.
The training is offered entirely outside the scope of professional training actions under Article L6313-1 of the Labor Code, with no certification, diploma, or professional objective, and without application for third-party funding or reimbursement.
The Client therefore agrees not to seek financial coverage from any third-party organization.
No certificate intended to justify professional training to an administration or funder will be issued.

Article 8 – Cancellation/termination and penalties

Except in cases of duly justified force majeure, cancellation is not allowed.
Client-initiated training cancellation: 

Except in cases of force majeure and compliance with the notice period, and in accordance with the legislative and regulatory provisions in force, any late cancellation will result in a flat-rate penalty of:
100% of the price if cancellation occurs two working days or less before the start of collective or e-learning training,
40% of the price if cancellation occurs two working days or less before the start of individual training.

Article 9 – Governing law / disputes

These general terms and conditions of sale are governed by French law.
In case of non-payment, the dispute falls under the jurisdiction of the competent courts. Any other dispute shall be subject, prior to referral to the competent court, to an attempt at amicable resolution and, failing agreement, to a consensual solution with the assistance of a mediator jointly appointed by the parties.
